Site specific conditions 1. The sale volume is all the area outlined in yellow and marked coupe 2b,3a and 3b on the Hazards and Constraints map The total felling area is approximately 44 hectares in three coupes. The perimeter of the felling area will be marked with tape or paint marks on trees. Felling is to commence in coupe 2b then 3a and finally subject to satisfactory progress and road condtions coupe 3b will be worked. The sale is for 15,000t contained in coupes 2b and 3a (with an option on a further 3000t in coupe 3b). 2. There are patches of windblow scattered through the coupe which are to be cleared as part of the sale. 3. The ground is mainly level with, moderate slopes, watercourses and areas of wet ground. 4. There a number of environmental constraints on the site as follows; a) Archaeological feature (farmstead) present within the felling area, grid reference NN 75899 05349. b) There is a watercourse in coupes 3a and 3b. c) There are gates on the access road that should be kept closed when there is stock in the fields. 5. The stacking area and machinery parking / refuelling bay locations are to be agreed with the site manager, Douglas Hyslop 6. The site is accessed via the minor county road from Stockbridge to Dalbrack and then via the newly constructed forest road from Wester Glastry past Dalbracks cottage and into the woodland, the internal forest roads have recently been upgraded to make them suitable for timber lorries. 7. a) Any maintenance works required during the harvesting operations to allow timber extraction or mitigate environmental damage are the responsibility of the purchaser. b) Road repair and maintenance of the forest road from where it first joins the public road (at the south end of the bypass) are the responsibility of the purchaser during the sale period. c) The construction or excavation of any harvesting tracks, benches, stacking areas or ramps must be discussed with and agreed by the Scottish Woodlands site manager. 8. a) There are overhead powerlines crossing the newly constructed forest access road.. b) There is a major watercourse running along the western boundary of the woodland and passing underneath the access route. 9. A detailed wildlife survey has NOT been undertaken, a) Red squirrels may be present on the site, it is the responsibility of the purchaser to ensure any wildlife constraints are identified and the permissions obtained from the relevant statutory bodies before harvesting works commence. b) Red Kites are present in the area and may be nesting in the woodland, although this cannot be confirmed as an exhaustive survey has not been undertaken, it is incumbent on the Purchaser to check the felling area is free from active nests. 10. Lop and Top, all lop and top material of less than 6 cm diameter to be cut through to a maximum length of 1.5 metres and left flat to the ground and laid clear of roads, rides, ditches, boundaries, protected vegetation and fences. 11. All other material over 6 cm is included in the sale and shall be removed from site. 12. Access cutting, non commercial trees and standing deadwood: the removal of trees, branches and bushes to allow ingress to the working site must be undertaken in a neat and tidy fashion, generally using a chainsaw or hand saw and the arisings must be cut and stacked neatly. Trees, branches and bushes may not be snapped, pushed over or bulldozed using harvesting machinery. Similarly, non commercial trees that impede harvesting progress on the site must be cut and treated as lop and top. Standing deadwood trees must be left standing unless prior written consent is given to remove them. 13. a) The purchaser will ensure that watercourses are not contaminated by lop and top, brash, fuel, oil, excessive volumes of earth or silt, and any chemicals used on the site, and that the F.C Forest and Water Guidelines will be adhered to. b) Any watercourse crossings constructed during harvesting operations must be removed on completion of works unless otherwise agreed with the forest manager. 14. Stumps are to be kept as low as is reasonably practical (less than 150mm) and large buttressed trees are to be reduced by manual chainsaw cutting if necessary. NOTE - Offcuts are considered merchantable timber and must be removed unless agreed otherwise by prior written consent. 15. A site meeting will be held prior to commencement of harvesting with the successful Purchaser to agree extraction routes avoiding watercourses, archaeological features, badger setts, identified hazards and other similar constraints. 16. The hazard and harvesting maps form part of the sale agreement and must be adhered to at all times. The harvesting map details the indicative stacking areas, fuelling points, haulage routes and any other harvesting constraints, any changes to or deviation from the mapped plan must be agreed in writing beforehand. 17. All damage to the property must be made good or paid for by the Purchaser. The Purchaser will indemnify the Seller against any and all third party claims arising from the Purchasers operations and will provide and keep in force appropriate insurance cover for the duration of the contract for no less than 5 million pounds sterling for public liability. 18. The harvesting operations must be completed without interruption,excepting normal work time stoppages and stoppages for service or repairs, bad weather or health and safety considerations. Prior written consent is required for all other interruptions. 19. The purchaser must give reasonable completion notice (at least 48 hrs) to the seller prior to leaving the site. 20. Upon completion of harvesting the Purchaser must ensure that any warning signs that have been put up are removed from the site, any waste (eg; oil / fuel drums, food and food packaging waste, machine servicing waste, etc ) is removed from site by the contract completion date or by a pre- agreed date. A charge will be made to the Purchaser for the removal of these items after this date. 21. The harvesting works are managed in accordance with a felling licence issued by Forestry Commission Scotland 16FGS06214. 22. The site is FSC certified under a group membership scheme SGS-FM/COC-000260-354 23, Prospective bidder should make sure they are familiar with and understand the terms of the Timber Transport management plan for Upper Grainston, in particular; a) Lorry configuration b) Frequency of vehicle movement, (there is currently no harvesting work scheduled in other forests covered by this agreement in this contract period). c) Timings of vehicle movements d) No convoys of vehicles e) Seasonal restrictions. 24. Payment Terms and Conditions 1. Payment Terms: net monthly on receipt of vendors invoice and subject to satisfactory creditworthiness. 2. A refundable bond of forty thousand pounds or five percent of the agreed total value of the contract will be required by John Clegg and Co prior to commencement of work. On satisfactory completion of works the bond will be returned to the purchaser. 3. The successful purchaser will be required to pay a 1% buyers premium in addition to the bid price prior to commencing harvesting. 4.The estimates given above of the numbers, sizes, volumes and weights of the trees are given without warranty of any sort as to their accuracy . Persons offering for the timber must satisfy themselves as to the exact size and nature of the trees offered for sale. 5. Weigh tickets must be returned within five working days of the end of the week of uplift. 6. All timber to be removed from the site by completion date 7. The sale will be subject to the current Scottish Woodlands standing sales contract with the details specific to this contract added as a memorandum of sale. ( A copy of the Scottish Woodlands sales contract is available to bidders). 8. The owners and their agents do not bind themselves to accept the highest or any offer. 9. Offers are invited on a standing weighted average price per tonne basis. 10. Security cameras may be used to monitor vehicle movements and timber uplift. 11. Scottish Woodlands will operate a PIN system for dispatch of timber from this site.
