Site Specific Conditions. 1) Site specific maps and combination code for the gate are available by e-mail from Charlotte.Cavey-Wilcox@scottishwoodlands.co.uk, these include a) Location map, b) Hazard map, c) Operations map 2) Lop and Top, all lop and top material of less than 6 cm diameter to be cut through to a maximum length of 2.0 metres and left flat to the ground and laid clear of roads, rides, ditches, boundaries, protected vegetation and fences. 3) All other material over 6 cm is included in the sale and shall be removed from site. 4) Access cutting, non commercial trees and standing deadwood: the removal of trees, branches and bushes to allow ingress to be working site must be undertaken in a neat and tidy fashion, generally using a chainsaw or hand saw and the arisings must be cut and stacked neatly. Trees, branches and bushes may not be snapped, pushed over or bulldozed using harvesting machinery. Similarly, non commercial trees that impeded harvesting progress on the site must be cut and treated as lop and top. Standing deadwood trees must be left standing unless prior written consent is given to remove them. 5) All standing and lying deadwood and important habitat trees are EXCLUDED from the sale, these trees will be clearly identified by both parties prior to work commencing on site. 6) The purchaser will ensure that watercourses are not contaminated by fuel, oil, excessive volumes of earth or silt, and any chemicals used on the site, and that the F.C Forest and Water Guidelines will be adhered to. 7) Stumps are not to be treated with Urea. They are all to be kept as low as is reasonably practical (less than 150 mm) and large buttressed trees are to be reduced by manual chainsaw cutting if necessary. NOTE - Offcuts are considered merchantable timber and must be removed unless agreed otherwise by prior written consent. 8) A site meeting will be held prior to commencement of harvesting with the successful Purchaser to agree (and possibly mark) the detailed (secondary) extraction routes but in general these will be to the primary extraction routes as mapped on the harvesting map, avoiding watercourses, archaeological features, badger setts, identified hazards and other similar constraints. A site instruction card will be provided noting those features to be taken into account by the purchaser in their risk assessments. 9) The hazard and harvesting maps from part of the sale agreement and must be adhered to at all times. The harvesting map details the stacking areas, fuelling points, haulage routes, primary and secondary extraction routes and any other harvesting constraints, any changes to or deviation from the mapped plan must be agreed in writing beforehand. 10) All damage to the property must be made good or paid for by the Purchaser. The Purchaser will indemnify the Seller against any and all third party claims arising from the Purchasers operations and will provide and keep in forces appropriate insurance cover for the duration of the contract for no less than 5 million pounds sterling for public liability. 11) The harvesting operations must be completed without interruption,excepting normal work time stoppages and stoppages for service or repairs, bad weather or health and safety considerations. Prior written consent is required for all other interruptions. 12) The purchaser must give reasonable completion notice (at least 48 hrs) to the seller prior to leaving the site. 13) Upon completion of harvesting the Purchaser must ensure that any warning signs that have been put up are removed from the site, any waste (eg; oil / fuel drums, food and food packaging waste, machine servicing waste, etc ) is removed from site by the contract completion date or by a pre - agreed date. A charge will be made to the Purchaser for the removal of these items after this date. 14) The forest managers and owners will not allow harvesting and extraction machinery to travel on the forest road. Payment Terms and Conditions 1.Payment Terms: 5% deposit to the vendors agent. Payment to the vendor subject to returned weight tickets, monthly invoice and satisfactory creditworthiness. 2. The successful purchaser will be required to pay a 1% buyers premium in addition to the bid price prior to commencing harvesting works. 3.The estimates given above of the numbers, sizes, volumes and weights of the trees are given without warranty of any sort as to their accuracy . Persons offering for the timber must satisfy themselves as to the exact size and nature of the trees offered for sale. 4. Copy weight tickets must be returned to the vendor within 10 days of uplift. 5. A secure system of access and authority to uplift will be in place - please discuss with the vendor. 6. All timber to be removed from the site by completion date with a final contract reconciliation to be made in the month following completion of felling. 7. The sale will be subject to the current Scottish Woodlands Standard Standing Sales Agreement. 8. The purchaser shall provide Scottish Woodlands woodlands with a monthly self billing invoice detailing all timber despatches and the corresponding settlement within 10 days of the end of the month of despatch. 9. Payment is then due by the 45th day after the end of the month of despatch. 10. All damage to the property must be made good or paid for by the Purchaser. The Purchaser will indemnify the Seller against any and all third party claims arising from the Purchasers operations and will provide and keep in forces appropriate insurance cover for the duration of the contract for no less than 5 million pounds sterling for public liability. 11. The owners and their agents do not bind themselves to accept the highest or any offer. 12. Offers are invited on a price per tonne through and through basis. 13. Security cameras may be used to monitor vehicle movements and timber uplift. 14. VAT maybe charged on the sale at the prevailing rate.
